By accessing or using act4pd.org (the “Site”) or participating in any services offered by Act4ParkinsonsTM (“we,” “our,” “us”), including donations, event registrations, auctions, and educational content (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”) and our https://a4p.brianyork.org/privacy-policy. If you do not agree, do not use the Site or Services.

1. Purpose & Scope

Act4ParkinsonsTM is a nonprofit organization dedicated to Parkinson’s education, awareness, and community support. These Terms govern your use of our Site and Services.

2. No Medical Advice

Content provided on the Site and at events is for informational purposes only and is not medical advice. Always seek guidance from qualified healthcare professionals regarding any medical condition.

3. Donations & Payments

  • Donations are generally nonrefundable. If you believe an error occurred, contact us within 14 days at [donations@act4pd.org].
  • Recurring donations will continue until canceled by you. You may cancel at any time via zeffy.com, paypal.com or by contacting us.
  • Payments are processed by third-party providers (e.g., Zeffy, PayPal). Their terms and privacy policies apply.

4. Events & Auctions

  • Event details may change. Tickets are nonrefundable unless otherwise stated, but may be transferable with notice.
  • Auction bids are binding. Winners must complete payment within 48 hours. Items are provided “as-is.”

5. Photo & Media Release

By attending events, you consent to photography and recording for promotional and educational purposes unless you opt out in writing prior to the event.

6. Intellectual Property

All content on the Site, including text, graphics, and logos, is owned by Act4ParkinsonsTM or licensed to us and protected by law. You may not reproduce or distribute content without prior written consent.

7. Acceptable Use

You agree not to use the Site for unlawful purposes, infringe rights, or transmit harmful code. We may suspend access for violations.

8. Third-Party Links

We are not responsible for content or practices of linked third-party sites. Use them at your own risk.

9. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACT4PARKINSONSTM SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM.

11. Governing Law

These Terms are governed by the laws of California, without regard to conflict of laws principles. Disputes shall be resolved in the courts of Monterey County, CA.

12. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.
